RE: ACLU Legal Observers

Dear Chief Dinse and Mr. Flowers,

This letter is to inform you that the ACLU of Utah will have volunteer legal observers attending protests in downtown Salt Lake City and at the University of Utah during the Olympics. The observers are not part of any group or organization that plans to demonstrate during the Olympics. They are strictly ACLU volunteers and the majority of them are University of Utah law students. The observers should in no way be counted as part of the numerical restrictions placed on some of the demonstration areas in Salt Lake City.

The monitors will primarily be involved in observing demonstrations from a distance and making notes. The ACLU of Utah considers any notes, photographs, video or tape recordings made during demonstrations attorney work product. Therefore, they are to be treated as privileged and confidential. The observers will inform any safety officer that asks for these notes and recordings of our position.

The monitors will be wearing royal blue knit hats that say “ACLU” in red on the front and “legal observer” in white on the back. They will also be carrying red, blue, or gray binders that have their identification information and the “ACLU” logo on the front. Please inform your officers assigned to monitor demonstration areas of their descriptions and function in order to avoid any unnecessary problems during the demonstrations.
