User Agreement
Welcome to www.acluutah.org, the website for the American Civil Liberties Union of Utah Union (ACLU of Utah Union) and the American Civil Liberties Union of Utah Foundation (ACLU of Utah Foundation), known collectively as the ACLU of Utah. The following User Agreement outlines our policies and practices with regards to this website. By using the ACLU of Utah website, you agree to follow any rules set forth in this User Agreement.
The ACLU of Utah Union and the ACLU of Utah Foundation
The ACLU of Utah is made up of two separate corporate entities: the ACLU of Utah Union and the ACLU of Utah Foundation. For information about the differences and the relationship between these two entities, please see www.acluutah.org/unionfoundation.htm.
Online Privacy Policy
The ACLU of Utah is committed to protecting any personal information you provide to us when using the ACLU of Utah website. The following policy describes how we treat user data we may collect during your visit to www.acluutah.org.
USER DATA WE COLLECT
We collect two types of user data: (1) anonymous data that our Internet Service Provider automatically collects from all visitors to www.acluutah.org; and (2) personally-identifiable data that you voluntarily provide us when you participate in certain activities on the website.
Anonymous Data: Our Internet Service Provider, XMission, collects and aggregates anonymous user information for www.acluutah.org, including anonymous site statistics, such as the number of visits to each page associated with the site.
Personal Data: On certain pages of www.acluutah.org, we give users the option of providing us with names, addresses, phone numbers, email addresses, and other personal information. This more personal information is gathered only with the user’s knowing and active permission and participation. You provide us with personal information when you participate in certain activities, such as:
- Making a tax-deductible donation to the ACLU of Utah Foundation;
- Joining or renewing your membership to the ACLU;
- Signing up for our monthly Activist Email Newsletter; or
- Submitting an online complaint.
HOW WE USE THE DATA WE COLLECT
We use anonymous data to determine which sections of the ACLU of Utah website are most visited so that we can evaluate the popularity of our different web pages and continue to improve our site. We do not link any anonymous data with personal data you may provide to us.
We use personal data to fulfill the request for which you specifically provided the data, such as:
- To confirm your contribution to the ACLU of Utah Foundation;
- To establish or renew your ACLU membership;
- To send you our Activist Email Newsletter; or
- To review and respond to your online complaint.
Note: We use Groundspring.org to process online donations and to manage our email list for our Activist Email Newsletter. Groundspring.org’s Privacy Policy is available at http://www.groundspring.org/privacypolicy.cfm. Also, membership contributions are processed through the national ACLU’s website. The national ACLU’s Privacy Policy is available at http://aclu.org/info/18864res20050401.html.
FINANCIAL DATA SECURITY
The ACLU of Utah uses Groundspring.org to process online donations. Groundspring.org maintains credit card information on their secure servers for internal processes only. They also use a credit card processing company to process donations; that company does not retain, share, store, or use personally identifiable information for any secondary purposes. RELATIONSHIP BETWEEN THE ACLU OF UTAH AND THE NATIONAL ACLU
ACLU members in Utah are automatically members of both the national ACLU and the ACLU of Utah. Therefore, both organizations have contact and dues information for members, and members may receive communications from both offices about state and national civil liberties issues and the work of the ACLU. Also, we provide contact and donation information to the national ACLU for people who have made a financial contribution to the ACLU of Utah. EXCHANGE OF PERSONAL INFORMATION
Except for providing member and donor information to the national ACLU, the ACLU of Utah does not share, exchange, or rent member or donor information, or our list of subscribers to the Activist Email Newsletter. The ACLU of Utah may share personal information associated with online complaints; however, we will only do so with the complainant’s consent and in an effort to resolve the complaint.
National ACLU does share personal information with other charities (read more about national’s sharing). When making a donation on the ACLU of Utah website, you can indicate that you want us to ask the national ACLU not to share your name and mailing address. Also, when renewing your membership or becoming a new member on the ACLU website, you can opt-out of having your personal data shared. At any time, you can fill out the national ACLU’s No-Exchange of Name Form.
COOKIES
The ACLU of Utah website does not use any cookies (alphanumeric identifiers that are transferred either to your computer’s hard drive or temporarily to your computer’s Random Access Memory).

PUBLIC RECORDS
Many legal documents on www.acluutah.org, such as documents submitted to a court or court rulings, are part of the public record and are often, but not always, available from government or commercial sources. Our use of the copyright statement for these documents is intended to protect the enhancement of the text for web presentation as well as its inclusion in our overall website. DISTRIBUTION REQUIRING ADVANCE WRITTEN PERMISSION
You must obtain written permission in advance if you wish to reproduce ACLU of Utah website content in digital format or for any reason not listed in the previous paragraph. You can request this permission by emailing us, at aclu@acluutah.org, the following information:
- A complete description of the material requested, including the URL of the web page that contains the ACLU of Utah content, a description of the sections or paragraphs that will be distributed, and, where applicable, the title and date of the ACLU of Utah content;
- A description of the intended audience;
- A description of the manner of distribution;
- The length, retail price, and approximate size of first printing or circulation that will include the ACLU of Utah content;

Trademark
American Civil Liberties Union, American Civil Liberties Union of Utah, ACLU, and ACLU of Utah and any other trademarks on the ACLU of Utah website (collectively known as “Trademarks”) are trademarks of the ACLU in the United States and other countries. You may not use the Trademarks for any product or service that does not belong to the ACLU, nor in any manner that is likely to cause confusion about whether we are the source, affiliated with, sponsor of, or endorser of any product or service. In addition, you may not use the Trademarks in any manner that disparages or discredits us.
Links, Frames, and Metatags
You may link to the home page of www.acluutah.org as long as the link does not cast the ACLU of Utah in a false or misleading light. The ACLU of Utah prefers advance notice of such linking, which can be provided by emailing aclu@acluutah.org. You may not frame the content of the ACLU of Utah website, or use metatags or any other “hidden text” that incorporates our name without express written consent.
Links to Other Websites
The ACLU of Utah website contains links to other websites that we think may be of interest to you. We have no control over these other sites or their content. Remember that when you link to another site, it is governed by its own User Agreement and Privacy Policy.
Disclaimers and Limitation of Liability
Although we intend to take reasonable steps to prevent the introduction of viruses, worms, “Trojan horses,” or other destructive materials to the ACLU of Utah website, we do not guarantee or warrant that the ACLU of Utah website or materials that may be downloaded from the ACLU of Utah website are free from such destructive features. We are not liable for any damages or harm attributable to such features.
Also, we are not liable for any claim, loss, or injury based on errors, omissions, interruptions, or other inaccuracies in the ACLU of Utah website, nor for any claim, loss, or injury that results from your use of the ACLU of Utah website or your breach of any provision of this User Agreement.
Termination
We reserve the right to terminate the ACLU of Utah website and this User Agreement at any time without notice for any reason, including, in the case of the User Agreement, for your violation of any of its provisions. The Limitation of Liability and Governing Law sections of this User Agreement survive any such termination.
Governing Law
The User Agreement is governed by the laws of the State of Utah applicable to contracts made and performed there without regard to its conflicts of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts in the State of Utah and Salt Lake County, and to waive any jurisdictional, venue, or inconvenient forum objections to such courts.
Changes to the User Agreement
From time to time, the ACLU of Utah may revise this User Agreement, including the Online Privacy Policy, so be sure to check this web page occasionally. If we do make material changes, we will post a notice on our home page that the User Agreement has been modified, and we will provide a link to the revised User Agreement. When you continue to use the ACLU of Utah website after we post a change to our User Agreement, it means that you agree to the new rules.
